DMCA

At Go Castle App, we respect the intellectual property rights of others and expect our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy explains how we respond to copyright infringement claims in accordance with the U.S. Copyright Act of 1976, and the DMCA.

We have implemented this policy to comply with the DMCA, and to protect the rights of copyright owners. If you believe that your copyrighted work has been infringed upon by content hosted on our website, please follow the steps below to submit a valid DMCA notice.

What to Consider Before Submitting a Copyright Complaint

Before submitting a complaint, we recommend you review the following:

  • If you are unsure whether the material you are reporting is infringing, we suggest contacting an attorney for advice.
  • The DMCA requires you to provide personal information when submitting a copyright infringement notification. If you prefer to keep your personal information private, you may choose to appoint an agent to submit the notice on your behalf.

Submitting a DMCA Notice

If you are a copyright owner, or authorized agent thereof, and believe that material on our website infringes your copyrights, you may submit a DMCA notice with the following information:

  1. Your Contact Information: Include your name, address, phone number, and email address.
  2. Identification of the Work: A description of the copyrighted work that you claim has been infringed. Please be as specific as possible.
  3. Identification of Infringing Material: A description of the material that is claimed to be infringing and its location on our website (e.g., URL of the page).
  4. Good Faith Statement: A statement that you have a good faith belief that the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy Statement: A statement that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or authorized agent.

What Happens After You File a DMCA Complaint

Once we receive a valid DMCA notice, we will review it for compliance with the DMCA and remove or disable access to the infringing material as required. We will also make a good faith effort to contact the user who uploaded the material to inform them of the action taken.

If we remove or restrict access to the material, the affected user may file a counter-notification, and we will follow the proper procedures under the DMCA to address this.

Please note that we are not required to take action if the notice does not comply with the DMCA’s requirements.

Filing a Counter-Notification

If you believe that material has been removed or access to it has been disabled due to a mistake or misidentification, you may file a counter-notification. The counter-notification must contain:

  1. Your Contact Information: Include your name, address, phone number, and email address.
  2. Identification of the Material: A description of the material that was removed or disabled and its location prior to removal.
  3. Statement of Good Faith: A statement that you have a good faith belief that the material was removed by mistake or misidentification.
  4. Agreement to Jurisdiction: A statement consenting to the jurisdiction of the U.S. District Court for the judicial district in which your address is located, or if outside the U.S., to any jurisdiction where we may be found.
  5. Signature: A physical or electronic signature.
